The Initiator identifies the dispute to negotiate, whether it’s a judicial dispute or a non-judicial dispute. For judicial disputes, the Initiator sends an offer to settle the dispute to the Respondent. For non-judicial disputes, the Initiator can either send his version of the facts of the dispute at stake to the Respondent, or the unpaid invoice.
For judicial disputes, the Respondent must make sure that the identified dispute is the right one. For non-judicial disputes, since there are no numbers associated with them, the Respondent must verify that the facts laid out by the Initiator are generally accurate and that there are no major inconsistencies between the Initiator and Respondent’s versions. If it is an unpaid invoice, it is imperative for the Respondent to authenticate the invoice prior to commencing the process.
